Questions

How much is the delay penalty?

Goods contracts often cut 0.5% of the value of delayed goods for each week of delay (part of a week counted as a full week), up to 10%. Works contracts (CPWD style) often cut 1.5% per month of delay worked out day by day, up to 10% of the contract value. Your contract decides the rate.

Can I get the penalty back?

If the delay was due to the department (late site, drawings, payments) or force majeure, you can ask for an extension of time without penalty. Keep letters and records of every hindrance.

Is GST charged on LD?

Under current GST rules, liquidated damages are generally not taxed. Check with your CA for your case.
